INTRODUCTION

These Terms and Conditions ("Terms") govern your use of the Desert Storm 2.0, event registration, and related services ("Services"). This is a legally binding agreement between you and Desert Storm 2.0 ("Desert Storm 2.0," "we," "us," or "our"). By accessing our website, registering for our event, or using any of our Services, you accept and agree to be bound by these Terms.

OVERVIEW

We reserve the right to modify these Terms at any time. When changes are made, we will display a notification on our website. You acknowledge that it is your responsibility to periodically review these Terms, and your continued use of our Services after modifications constitutes acceptance of the updated Terms.

BY USING THIS WEBSITE AND SERVICES, YOU AGREE TO BE BOUND BY THESE TERMS. IF YOU DO NOT AGREE WITH THESE TERMS, PLEASE EXIT THE SITE IMMEDIATELY.

1. EVENT SERVICES AND REGISTRATION

a. Event Description

Desert Storm 2.0 operates an annual performance boating event in Lake Havasu City, Arizona. Our Services include event registration, participant coordination, vendor management, spectator services, and related activities associated with the Desert Storm performance boating event.

b. Registration Requirements

To participate in Desert Storm as a registered participant, you must complete the registration process, provide accurate information, and pay all applicable fees. Registration is subject to availability and approval.

c. No Guarantee of Results

Although we work diligently to provide a quality event experience, we cannot guarantee specific outcomes, placements, or experiences. Participation in racing, exhibitions, and other event activities involves inherent risks.

d. Event Modifications

We reserve the right to modify event schedules, locations, activities, or other aspects of the event as necessary due to weather, safety concerns, or other factors beyond our control. We will make reasonable efforts to notify participants of significant changes.

e. Temporary Interruptions

You understand and agree that temporary interruptions of the website or event services may occur. You also understand that we have no control over third-party networks, services, or weather conditions that may affect the event.

2. PAYMENT AND FEES

a. Registration Fees

If you register as a participant, vendor, or sponsor, you agree to pay all associated fees. Fees vary based on registration type, timing, and selected services. Registration fees may include participant registration, vendor booth fees, sponsor packages, and related services.

Fees may change from year to year. Early registration typically offers discounted rates. Payment is required at the time of registration unless otherwise specified.

b. Payment Methods

We accept payment via credit card, debit card, and other methods as specified on our registration forms. All charges will be billed to the payment method provided at registration.

c. Overdue Amounts

If your payment method declines or refuses to pay the amount owed, we may cancel your registration and forfeit any deposits or fees already paid.

d. Refund Policy

Registration fees are generally non-refundable. However, we may issue refunds or credits at our sole discretion in the following circumstances:

  • Event cancellation by Desert Storm 2.0
  • Cancellation requests made more than 60 days before the event (subject to administrative fee)
  • Medical emergencies or extenuating circumstances (requires documentation)

Refund requests must be submitted in writing to [email protected] with supporting documentation.

3. CONDUCT AND SAFETY

a. Participant Conduct

All participants, vendors, spectators, and attendees must conduct themselves in a safe, lawful, and respectful manner. Prohibited conduct includes:

  • Reckless or dangerous operation of watercraft
  • Harassment, threatening behavior, or violence
  • Violation of local, state, or federal laws
  • Damage to property or equipment
  • Intoxication or substance abuse affecting safety
  • Interference with event operations or other participants

Desert Storm LHC reserves the right to remove any individual from the event for violating these conduct standards, without refund.

b. Safety Requirements

All participants must comply with safety requirements, including proper safety equipment, boat inspections, and adherence to speed limits and operating guidelines. Failure to meet safety requirements may result in disqualification.

c. Assumption of Risk

You acknowledge that participation in performance boating events involves inherent risks, including risk of injury or death. By participating, you voluntarily assume all risks associated with the event.

4. LIABILITY AND INDEMNIFICATION

a. Waiver of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE TO RELEASE, WAIVE, AND DISCHARGE DESERT STORM LHC, ITS OFFICERS, DIRECTORS, EMPLOYEES, VOLUNTEERS, SPONSORS, AND AFFILIATES FROM ANY AND ALL LIABILITY FOR INJURY, DEATH, PROPERTY DAMAGE, OR OTHER LOSSES ARISING FROM YOUR PARTICIPATION IN THE EVENT.

b. Indemnification

You agree to indemnify, defend, and hold harmless Desert Storm LHC from any claims, damages, losses, or expenses (including attorney fees) arising from your participation in the event, your violation of these Terms, or your violation of any laws or rights of third parties.

c. Insurance

Participants are strongly encouraged to maintain adequate insurance coverage for their watercraft, equipment, and personal liability. Desert Storm LHC is not responsible for damage to or loss of participant property.

5. INTELLECTUAL PROPERTY

a. Content Ownership

All content on the Desert Storm LHC website, including logos, graphics, text, images, and video, is protected by intellectual property rights and is the sole property of Desert Storm LHC or its licensors.

b. Use of Event Photography and Video

By attending or participating in the Desert Storm event, you grant Desert Storm LHC the right to use photographs, video recordings, or other media capturing your likeness or watercraft for promotional, marketing, or documentary purposes without compensation.

c. Trademark

The Desert Storm name, logo, and related marks are trademarks of Desert Storm LHC. Unauthorized use of these marks is prohibited.

6. SMS MESSAGING TERMS

Desert Storm LHC Text Messaging Program

By opting in to receive text messages from Desert Storm LHC, you agree to receive recurring automated marketing messages and event updates at the phone number provided. Messages may include event schedules, registration information, safety updates, promotional content, and important notifications.

Opt-Out Instructions

You can cancel the SMS service at any time. Simply text "STOP" to our number. Upon sending "STOP," we will confirm your unsubscribe status via SMS. Following this confirmation, you will no longer receive SMS messages from us.

Rejoining Instructions

To rejoin our text messaging program after opting out, you may sign up again through our website or registration forms, and we will resume sending SMS messages to you.

Carrier Disclaimer

Carriers are not liable for delayed or undelivered messages.

Message and Data Rates

Message and data rates may apply for messages sent to you from us and to us from you. Message frequency varies based on event schedule and important updates. For questions about your text plan or data plan, contact your wireless provider.

SMS Data Privacy

No mobile information will be shared with third parties or affiliates for marketing/promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, except for service providers necessary to deliver our communications to you.

Compliance

Our text messaging program complies with the Telephone Consumer Protection Act (TCPA), CTIA guidelines, and other applicable laws and regulations governing A2P messaging.

7. VENDOR AND SPONSOR TERMS

a. Vendor Requirements

Vendors must comply with all applicable laws, obtain necessary permits and licenses, maintain adequate insurance, and operate in a professional manner. Vendor booth assignments are at the discretion of Desert Storm LHC.

b. Sponsor Benefits

Sponsor packages include benefits as described in sponsorship agreements. Desert Storm LHC reserves the right to modify sponsor benefits with reasonable notice.

8. DISCLAIMER OF WARRANTIES

ALL SERVICES AND EVENT ACTIVITIES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

WE DO NOT WARRANT THAT THE EVENT WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, OR THAT RESULTS OBTAINED WILL MEET YOUR EXPECTATIONS.

WE RESERVE THE RIGHT TO MODIFY OR CANCEL THE EVENT AT ANY TIME DUE TO WEATHER, SAFETY CONCERNS, OR OTHER FACTORS BEYOND OUR CONTROL.

9. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, DESERT STORM LHC SHALL NOT BE LIABLE FOR ANY SPECIAL, PUNITIVE, INCIDENTAL, INDIRECT, OR CONSEQUENTIAL DAMAGES, INCLUDING THOSE RESULTING FROM INJURY, DEATH, PROPERTY DAMAGE, LOSS OF USE, OR LOST PROFITS, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF SUCH POSSIBILITY.

OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM THESE TERMS SHALL BE LIMITED TO THE AMOUNT YOU PAID FOR REGISTRATION OR SERVICES.

10. CANCELLATION AND TERMINATION

a. Event Cancellation

If Desert Storm LHC cancels the event, we will provide refunds or credits at our discretion. We are not liable for travel expenses, lodging costs, or other incidental expenses incurred by participants.

b. Participant Removal

We may remove any participant, vendor, or attendee from the event for violation of these Terms, safety concerns, or disruptive behavior, without refund.

11. MISCELLANEOUS PROVISIONS

a. Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflicts of law principles. Any disputes shall be resolved in the appropriate courts in Mohave County, Arizona.

b. Communications

Official notices must be sent in writing via email to [email protected]. We may send notices to your provided email address or mailing address.

c. Force Majeure

We shall be excused from liability for non-performance or delay arising from events beyond our reasonable control, including weather, natural disasters, government restrictions, labor disputes, or other similar causes.

d. Severability

If any provision of these Terms is held invalid, the remaining provisions shall remain in full effect.

e. Entire Agreement

These Terms constitute the entire agreement between you and Desert Storm LHC regarding the event and services, and supersede all prior agreements.
